CONTEST RULES AND REGULATIONS
Open to legal residents of Canada
By entering this Contest, entrants agree to abide by these Official Rules. The decisions of the independent contest organization with respect to all aspects of the Contest are final.
- SPONSOR & CONTEST PERIOD: The Old Dutch Win Chips for Life Contest (the "Contest") is sponsored by Old Dutch Foods Ltd. (the "Sponsor"). The Contest commences at 12:00:00 AM Eastern Time ("ET") on Oct 25, 2022 and will end at 11:59:59 PM ET on Jan 2, 2023 (the "Contest Period"). All times are Eastern Times.
- ELIGIBILITY: To enter the Contest and be eligible to win, a person ("Entrant") must be a legal resident of Canada, who at the time of entry has reached the age of majority in the province in which they reside. This Contest is not open to employees of the Sponsor, Petro Canada, participating stores, representatives or agents, their respective advertising or promotional agencies, the independent contest organization, or a member of any such employee's immediate family (regardless of where they live) or persons with whom any of the above are domiciled (whether related to the employee or not). In these Official Contest Rules & Regulations (the "Official Rules"), "immediate family" means mother, father, brothers, sisters, sons, daughters and/or legal or common-law spouse.
- HOW TO ENTER: No Purchase is Necessary. There are two (2) ways to enter the Contest:
- Online: During the Contest Period, visit olddutchcontests.ca (the "Contest Website"), select your province of residence and select the Petro Canada banner or enter the name of your local Petro Canada store in the search field to be directed to the entry form (the "Entry Form"). Complete the Entry Form with your full name, complete mailing address (including postal code), a valid email address, daytime telephone number (including area code) and select the Petro Canada Store location where you purchased your participating product. Next, answer correctly, without assistance of any kind, whether mechanical or otherwise, the mathematical skill-testing question, confirm compliance with these Official Rules, confirm that you are the age of majority or older at time of entering the Contest . Upon doing so, click "Submit" and you will receive one (1) entry (an "Entry") into the Draw (see rule 6). Entries must be received on or before 11:59:59 PM ET on Jan 2, 2023 (the "Contest Closing Date")..

- Mail-in: On a plain piece of paper, hand-print your full name, complete mailing address, daytime telephone number (including area code), a valid email address, the name of your local Petro Canada store, the following statement: "I have read, understand and agree to these Official Rules", your favorite Old Dutch chip and flavor, the correct answer to the following mathematical skill testing question (16 x 2) + (60 ÷ 4) – 7 = _____ and mail with sufficient postage to: Old Dutch Win Chips for Life Contest, Dept 4229 Box 9500 Lakeshore West PO, Oakville ON, L6K 0G4. Each mail-in entry must be an original (no photocopies or other reproductions) and mailed in a separate envelope, bearing sufficient postage. Mail-in Entries must be post marked no later than the Contest Closing Date and must be received prior to the Draw Date (see rule 6).
By entering the Contest, you are confirming compliance with these Official Rules, and if selected for a Prize, accepting of the Prize as awarded, without substitution, and releasing the Sponsor, its respective affiliates, advertising and promotional agencies, the independent contest organization, and their respective shareholders, directors, officers, employees and agents (collectively the "Releasees") from and against all liability in connection with the Contest and/or the awarding and use of a Prize, and consenting to the use of your name, address (city and province/territory), and/or photographs, without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor with respect to the Contest.
- ENTRIES: Limit of one (1) Entry per person per day during the Contest Period regardless of method of entry. A "day" is defined as starting at 12:00:00 AM ET and ending at 11:59:59 PM ET on the same day. Only one (1) email account per person may be used. Any person who is found to have entered in a fashion not sanctioned by these Official Rules including but not limited to using multiple email accounts to enter or submitting more than the number of Entries permitted by these Official Rules will be, along with all entries submitted by such persons, ineligible and immediately disqualified. The Sponsor reserves the right in its sole discretion to disqualify all such individuals from future contests conducted by the Sponsor without further notice. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. The Sponsor will not be responsible for late, lost, illegible, falsified, damaged, misdirected, mutilated, garbled or incomplete entries, which will be void. All Entries become the property of the Sponsor upon receipt and none will be returned.
- PRIZE: There will be one (1) prize (the “Prize”) available to be won, consisting of Old Dutch Chips for Life*, which will be awarded as $5,000.00 (CDN) in prepaid Gift Cards. *The value of the Prize has been calculated based on an national average sell price of one (1) bag of Old Dutch Rip-L Potato Chips Plain 235g per week over 25 years, each bag having an approximate retail value (“ARV”) of $3.50 (CDN).
Prepaid Gift Cards are subject to separate terms and conditions. Prize must be accepted as awarded without substitution, is not transferable, not for resale and has no cash surrender value. The Sponsor reserves the right, in the event that the Prize cannot be awarded as described for any reason, to substitute another prize of equal or greater value, without liability. Only one (1) Prize will be awarded.
- PRIZE DRAW: A random draw will be held at the office of the independent contest organization located at 2390 Bristol Circle. Unit #3, Oakville, ON on Jan 5, 2023 at 10:00:00 AM, (the "Draw Date") from among all eligible Entries received. Odds of being selected depend on the total number of eligible Entries received. The selected Entrant will be contacted by telephone and/or email within five (5) business days of the Draw Date. If the selected Entrant (a) cannot be reached by telephone and/or email within five (5) business days of being selected after reasonable attempts; or (b) fails to correctly answer the skill testing question (see rule 7), then they will be disqualified and another Entrant will be randomly selected until such time as contact is made by telephone and/or email with a selected Entrant or there are no more eligible Entries, whichever comes first. The Sponsor will not be responsible for failed attempts to contact a selected Entrant.
- To be declared the Prize winner, a selected Entrant's answer to the mathematical skill-testing question must be determined to be correctly answered. The selected Entrant will also be required to sign a Declaration and Release Form (the "Release Form"), which: (i) confirms compliance with these Official Rules; (ii) acknowledges acceptance of the Prize as awarded, without substitution; (iii) releases the Releasees (as defined in rule 3) from any liability in connection with the Prize or any portion thereof or this Contest; and (iv) confirms the selected Entrant's agreement to the publication, reproduction and/or other use of the selected Entrant's name, address, voice, statements about the Contest, photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast and the internet. The Release Form must be returned within the time period specified on the Release Form or the Prize will not be awarded. The Prize will be couriered to the winner within four (4) to six (6) weeks of receipt and verification of their Release Form.
- CONDITIONS OF ENTRY: By entering the Contest, Entrants (i) acknowledge compliance with these Official Rules including all eligibility requirements, and (ii) agree to be bound by these Official Rules and by the decisions of the independent contest organization, made in its sole discretion, which shall be final and binding in all matters relating to this Contest. Entrants who have not complied with these Official Rules are subject to disqualification.
- GENERAL: The Releasees do not assume any responsibility and are not responsible for (i) the incorrect or inaccurate capture of entry information and entries that fail to comply with the Official Rules; (ii) any loss, damage, or claims caused by the awarded Prize or the Contest itself; or (iii) any failure of the Contest Website during the Contest Period, including any problems, human or technical, printing errors, lost, delayed, garbled data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone or computer lines, or technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an Entrant's or any other person's computer related to or resulting from downloading any material connected to the Contest, all of which may affect a person's ability to participate in the Contest. Entry material/data that has been tampered with or altered is void. The use of an invalid email address will disqualify the Entry. Users spamming the same email address will disqualify the entry. In the event of a dispute, entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. The selected Entrant may be required to provide proof that they are the authorized account holder of the email address associated with the selected Entry. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s). In the event it is determined that an Entrant has entered in a fashion not sanctioned by these Official Rules and/or has submitted more than the number of Entries permitted by these Official Rules, the Entrant will be disqualified and all of the entries submitted by the Entrant will be disqualified.
- All issues and questions concerning the construction, validity, interpretation, and enforceability of the Official Rules, or the rights and obligations of Entrants and the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein in respect of residents of the other Canadian provinces/territories, without regard to conflicts of law principles. Any attempt by a participant or any other individual to deliberately damage any website or undermine the legitimate operation of the Contest could be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. This Contest is subject to all federal, provincial, territorial and municipal laws.
- In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and disclosures or other statements contained in any Contest related materials, including, but not limited to point of sale, print or online advertising, the terms and conditions of these Official Rules shall prevail, govern and control to the fullest extent permitted by law.
- The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux (the “Regie”), to terminate or suspend this Contest or to amend the Official Rules at any time and in any way, without prior notice, for any reason whatsoever. Without limiting the foregoing, if for any reason the Contest is not capable of running as originally planned, for example as a result of tampering or infection by computer virus, the Sponsor reserves the right, with the consent of the Régie, to terminate the Contest and conduct a random draw from all previously received eligible Entries.
- FOR QUEBEC RESIDENTS: Any litigation respecting the conduct and awarding of the Prize in this Contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
- CONSENT TO USE PERSONAL INFORMATION: The Sponsor respects your right to privacy. Personal information collected from Entrants will only be used by the Sponsor to administer the Contest.
